Terms and Conditions

1. General Provisions

(1) The following Terms and Conditions apply to sales between Moouny GmbH (hereinafter “us”) and the buyer (hereinafter “you”). Any terms and conditions that you propose or to which you object require our written consent. By placing an order with us, you are deemed to have read, understood, and agreed to our General Terms and Conditions.

(2) We reserve the right to supplement, delete, or amend these General Terms and Conditions at any time and at our sole discretion without prior written notice.

2 – Contract

(1) Orders may only be placed via the website www.moougames.com. Once you have completed the order form and confirmed your order, a contract between you and us is formed in accordance with the terms and conditions set forth below, without the need for a separate confirmation of acceptance on our part.

(2) The order placed and the selected terms and conditions govern the delivery of our products. The prices and terms and conditions displayed at the time of your order and confirmation apply.

(3) You confirm that you are ordering the products for your personal, non-commercial use. The resale of the purchased products for commercial purposes is prohibited. Please note that we will assert our relevant rights. If you wish to place an order for a larger volume or for commercial distribution, please contact us to place a custom order (moounygmbh@gamil.com). In the event of a lack of information, large order quantities, or high order rates within a short period of time, we reserve the right to reject or cancel your order.

3 – Product Colors

Please note that while we have tried to accurately represent the colors of the products, the actual colors you see depend on your monitor and may not be exact.

4 – Prices and Payment

Customs Duties and Taxes
Prices are listed in CHF, EUR, or USD, depending on your location. For EU countries, the U.S., and Switzerland, VAT is included in the displayed price. For all other countries, the displayed prices are net.

If the shipping address is not in the EU, the U.S., or Switzerland, you may be charged the applicable import duties and sales taxes of that country.

Country Selection
Your shipping country is automatically selected when you visit our website. However, you can change it at any time using the dropdown menu in the footer or during the checkout process. Changing the delivery country will result in a change to the displayed price (currency and/or VAT).

Prices and Payment
You will be charged the total cost of the items you ordered, as displayed on the website. Payment methods accepted by Shopify Payments.

5 – Shipping

6 – Your Return Rights

(1) We gladly accept returns for any reason within 30 days of the shipping date. Shipping costs are non-refundable.

(2) We will inspect all returned products. All items must be returned in perfect condition, with no signs of use, in their undamaged original packaging. You are responsible for paying the postage fees for this type of return. We will refuse the returned product if:

– The product shows visible signs of use
– The product is damaged during return shipping
– The original packaging is missing or damaged

We will refund your payment (excluding customs duties, taxes, and other fees). In the event of a return, you will be charged for all shipping costs.

The refund of the purchase price will be issued via the same method used for the original payment.

(3) If the products are lost during return shipping, we will not cover any costs. We recommend that you return all items using a shipping carrier that offers a Track & Trace service.

7 – Our Rights

If you have provided us with false information regarding your creditworthiness, we reserve the right to withdraw from the contract in whole or in part.

8 – Retention of Title

The goods remain our property until you have fully settled all claims, including any current account balance, as of the date the contract is concluded.

9 – Warranty

(1) We provide a lifetime warranty against defects in materials or workmanship. This means that defective parts that have not become unusable due to misuse or normal wear and tear will be replaced free of charge with identical or equivalent products. Any warranty claims beyond this, as well as liability for damages resulting from the use of our products, are expressly excluded.

(2) It is your responsibility to inspect the products upon delivery. If you fail to do so, you forfeit your rights.

(3) In all other respects, claims for damages and compensation are governed by the provisions of Swiss law, and we are liable only for gross negligence and willful misconduct. This also applies to our employees and other agents. Mandatory statutory provisions (e.g., the Product Liability Act) remain unaffected.

10 – Secure Transactions

Our e-commerce system uses SSL (Secure Sockets Layer)—the industry standard for encryption technology used to create a secure transaction environment for online commerce.

11 – Copyrights

All rights to trademarks, designs, texts, and all other products are subject to our exclusive copyright. This website is protected by copyright. Modifications, reproductions, and any imitation or copying are prohibited.

12 – Miscellaneous Provisions

(1) All terms and conditions and contracts under this Agreement are governed by Swiss law, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The court of competent jurisdiction is Zurich, Switzerland.

(2) Should any provision of these General Terms and Conditions of Delivery prove to be wholly or partially invalid, the contracting parties shall jointly seek a provision that comes as close as possible to the invalid provision in both legal and economic terms.
